BILL OF RIGHTS

1st Amendment: The Five Freedoms

Can you think of any restrictions that might be placed upon a man’s freedom to worship in whatever manner he so chooses?

2nd Amendment: Right of Protection

There are restrictions placed upon a person’s constitutional right “to bear arms”.  What do you think they are?

3rd Amendment: Quartering Soldiers

Where do you think the idea for this amendment came from?

4th Amendment: Search and Seizure

Under the 4th Amendment, what do you think the police can search without a warrant?

5th Amendment: Fair Trial in Open Court

What is the difference between a capital crime and an infamous crime?

6th Amendment:  Your Miranda Rights

We already studied these!  J

7th Amendment:  Civil Trials

What is the difference between criminal and civil cases?

8th Amendment: No Cruel or Unusual Punishment

Amendment 8 protects criminals from any form of “cruel and unusual punishment”.  Some people consider today’s death penalty “cruel”, how would you argue this?

9th Amendment:  Basic Rights in Life Decisions

Amendment 9 says that any powers not specifically named in the Constitution should go to the people.  What “life decisions” should we have complete control over, the government should have no say in?

10th Amendment:  States’ Rights

The rights of the states are protected under this amendment – any powers not specifically noted in the Constitution must then go to the states.  An example of this would be driving regulations; the states make the driving laws for its citizens.  Give an argument against the 10th amendment, saying why different driving regulations could cause a problem between the states.
